Property Licensing in Tower Hamlets and Your Gas Safety Certificate

Tower Hamlets has mandatory and additional HMO licensing; the brief’s position dated 5 October 2026 records no selective scheme in force.

Where gas is supplied, Housing Act 2004 Schedule 4 licence conditions require an annual gas safety certificate to be produced on demand.

Verify: each scheme's status on the Tower Hamlets council page before publishing - schemes started/ended Aug-Oct 2026.

See property licensing across London.

Mandatory HMO licensing

borough-wide statutory scheme for qualifying homes occupied by five or more people forming two or more households.

Additional HMO licensing

borough-wide, from 1 April 2024 to 31 March 2029.

Selective licensing

the designation covering Whitechapel, Weavers, and Spitalfields & Banglatown wards, using pre-22 May 2014 boundaries, ran from 1 October 2021 to 30 September 2026.

Rented Homes in Tower Hamlets

Private renting accounted for 38.2% of Tower Hamlets households in the 2021 Census, up from 32.6% in 2011. A further 35.9% rented socially.

Housing includes Victorian terraces and conversions around Roman Road and Mile End, heritage mansion blocks at the Boundary Estate, and post-war estates around Poplar. The property’s appliances determine the check: homes with landlord gas appliances need the annual record. A communal heating connection alone does not establish whether a flat has gas appliances.

CP12 and Boiler Service Together in Tower Hamlets

The safety check and a boiler service following the manufacturer’s schedule can take place in one visit. They remain separate activities: servicing does not replace the annual check required for a rented home. Keep the CP12 with your boiler maintenance paperwork. Arrange.

Letting Agents and Portfolios in Tower Hamlets

Agents and portfolio landlords should track each property’s renewal deadline and arrange tenant access before booking. Under regulation 36A, checks within the two months before each deadline preserve that date. Keep separate records for each address, including any licence details and tenant-copy dates. Gas Safety Enforcement in Tower Hamlets

A genuine annual record provides evidence of the gas safety check for Tower Hamlets landlords. The council also tells its own tenants that it carries out annual boiler servicing and safety checks.

Check the engineer’s Gas Safe ID and relevant work categories, then match the record’s address, appliances and engineer details. The Register verifies registration, not individual certificates. Learn how to check a gas safety certificate and verify an engineer.

What Is Changing for Tower Hamlets Landlords

The selective licensing designation ended on 30 September 2026, according to the brief’s October update; additional HMO licensing continues until 31 March 2029. Ending a licensing scheme does not remove the annual gas safety duty for rented homes with landlord gas appliances.

Frequently Asked Questions

Does my licensed shared flat need a CP12 and a boiler service?

Gas safety records and boiler servicing are separate: one is a legal record, the other maintenance. For a licensed shared flat with landlord gas appliances, the CP12 check is annual.

Does my Canary Wharf or Wood Wharf flat on district heating need a CP12?

District heating alone does not determine whether you need a CP12: check whether the flat has landlord gas appliances or relevant flues. A gas hob still needs checking. If there is no individual gas boiler, there is no individual gas boiler to service.

What gas paperwork is needed in Whitechapel’s former selective licensing area?

A rented Whitechapel home with landlord gas appliances still needs an annual Landlord Gas Safety Record. The selective designation ended on 30 September 2026 according to the October update. Supply the tenant’s copy as required, and check whether mandatory or additional HMO licensing applies.

Does an unlicensed Tower Hamlets rental need a gas safety certificate?

Yes, a rental with landlord gas appliances and flues needs the annual check under regulation 36, whether licensed or not. A licensing exemption does not remove that duty. Give existing tenants the record within 28 days and new tenants a copy before they move in.

How early can I renew without changing the deadline?

You can arrange the check in the two months before the existing deadline and retain that deadline under regulation 36A. This is an early-check window, not extra time after expiry. Keep the previous record available and organise tenant access before the due date.
